Consumer Compliance Handbook
November 2009 Update
Included in the November 2009 update are two new chapters. One of these chapters contains background information and examination procedures to be used when determining compliance with the Servicemembers Civil Relief Act (SCRA). The SCRA seeks to strengthen the national defense by providing for the temporary suspension of judicial and administrative proceedings and transactions that may adversely affect the rights of servicemembers during their military service. The other new chapter covers the Protecting Tenants at Foreclosure Act, which aims to ensure that tenants facing eviction from a foreclosed property have adequate time to find alternative housing. This chapter includes background information and examination procedures as well.
Also included in this update are revised fair lending examination procedures. The revised examination procedures reflect significant recent changes in credit markets, products, and practices; they clarify procedures related to pricing, steering, redlining, broker activity, performing examinations with small sample sizes, and data accuracy.
